Burden of proof The duty to establish a claim or allegation by admissible evidence. This is usually the duty of the plaintiff in a civil case and always is the duty of the state in a criminal case. Entrapment In criminal procedures, a complete defense. The defendant must show that officers induced the defendant to commit a crime not contemplated by him, for the purpose of instituting a criminal prosecution against him. Executor A person assigned to carry out the provisions of a will Conditional release A release from custody, which imposes regulations on the activities and associations of the defendant. If a defendant fails to meet the conditions, the release is revoked. False arrest Any unlawful physical restraint of another's personal liberty, whether or not carried out by a peace officer Unlawful detainer A detention of real estate without the consent of the owner or other person entitled to its possession. Alibi A defense claim that the accused was somewhere else at the time a crime was committed. Calendar A court's list of cases for arraignment, hearing, trial or arguments.
